Pursuant to article 33(1) of Presidential Decree no. 445 of 28 December 2000, “signatures on deeds and documents drawn up in the State and to be valid abroad before foreign authorities shall, if requested by the latter, be legalised by the competent central or peripheral bodies of the competent Ministry, or by other bodies and authorities delegated by it”.
The legalisation for use abroad procedure consists in a series of certifications involving various Italian public agencies – including Prefectures, District Attorney’s Offices or Chambers of Commerce, depending on the case – through to the authentication issued by the diplomatic-consular representative in Italy of the Country in which the document is to be presented or through to the application of the Apostille for documents intended for use in Countries that signed the Hague Convention of 5 October 1961.
The legalisation for use abroad procedure can be applied to both public documents and the authentication of private agreements, minor authentications and the application of the certificate on copies and excerpts.
Deeds and documents in general drawn up in Italian alone will have to be translated into the language of the foreign country in which they are to be used. In order to have legal effects in another country, the translation will need to be sworn and legalised.
