{"id":7712,"date":"2021-06-15T19:58:44","date_gmt":"2021-06-15T17:58:44","guid":{"rendered":"https:\/\/www.italiancertificates.com\/v2\/uncategorized\/certificate-of-outstanding-criminal-proceedings\/"},"modified":"2021-06-15T19:58:44","modified_gmt":"2021-06-15T17:58:44","slug":"certificate-of-outstanding-criminal-proceedings","status":"publish","type":"post","link":"https:\/\/www.italiancertificates.com\/en\/blog\/certificate-of-outstanding-criminal-proceedings\/","title":{"rendered":"Certificate of outstanding criminal proceedings"},"content":{"rendered":"<p dir=\"ltr\">This is the certificate issued by the\u00a0<strong><a title=\"Public Prosecutor Office at the Court of Milan\" href=\"http:\/\/www.procura.milano.giustizia.it\/\" target=\"_blank\" rel=\"noopener\">Public Prosecutor Office<\/a>\u00a0<\/strong>to verify the existence of\u00a0<strong>outstanding criminal proceedings<\/strong>, already registered in a particular Public Prosecutor\u2019s office, involving the person owner of the certificate.<\/p>\n<p dir=\"ltr\">This certificate, therefore, lists any\u00a0<strong>ongoing criminal proceedings<\/strong>\u00a0that have\u00a0<strong>not yet reached final or definitive judgement<\/strong>.<\/p>\n<p>The certificate of pending proceedings should be requested from the Office of the Prosecutor with\u00a0<strong>jurisdiction for the place of residence of the person involved<\/strong>.<\/p>\n<p dir=\"ltr\">This certificate, in fact,\u00a0<strong>does not list all pending criminal proceedings at national level<\/strong>\u00a0but only those currently pending before the court to which the questioned prosecutor has access. If the party concerned wishes to know the pending proceedings in other judicial offices, he\/she must submit a request for the certificate to all Public Prosecutor\u2019s offices concerned.<\/p>\n<p dir=\"ltr\">The certificate of outstanding criminal proceedings is\u00a0<strong>valid for 6 months only<\/strong>.<\/p>\n<p dir=\"ltr\"><a href=\"http:\/\/italiancertificates.com\/wp-content\/uploads\/2014\/05\/Certificate-of-outstanding-proceedings.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-1589\" title=\"Certificate of outstanding proceedings\" src=\"https:\/\/italiancertificates.com\/wp-content\/uploads\/2014\/05\/Certificate-of-outstanding-proceedings-211x300.jpg\" alt=\"example of Italian certificate of outstanding proceedings\" width=\"211\" height=\"300\" \/><\/a><\/p>\n<p dir=\"ltr\"><em>The following are the requirements to obtain it:<\/em><\/p>\n<ul>\n<li dir=\"ltr\">\n<p dir=\"ltr\">an application letter accompanied by a copy of a valid identity document<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">One \u20ac 16.00 revenue stamp (Law 71\/2013 \u2013 OJ No. 147 of 25\/06\/2013)<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">One \u20ac 3,68 \u00a0certificate charge stamp<\/p>\n<\/li>\n<li dir=\"ltr\">\n<p dir=\"ltr\">One additional \u20ac 3,68 \u00a0\u00a0priority fee stamp (priority release is not possible in cases in which the certificate is positive, i.e. those involving pending proceedings)<\/p>\n<\/li>\n<\/ul>\n<p dir=\"ltr\">The certificate\u00a0<strong>can be retrieved by another person<\/strong>\u00a0empowered by the applicatn through a\u00a0<strong><a title=\"Proxy to retrieve the certificate\" href=\"https:\/\/www.giustizia.it\/resources\/cms\/documents\/modello5.pdf\" target=\"_blank\" rel=\"noopener\">proxy<\/a><\/strong>.<\/p>\n<p>Where needed, this \u00a0certificate can be\u00a0<strong><a title=\"The legalization process\" href=\"https:\/\/www.italiancertificates.com\/en\/blog\/the-legalization-process\/\" target=\"_blank\" rel=\"noopener\">legalized or apostilled<\/a><\/strong>\u00a0and\u00a0<strong><a title=\"Certified translations and legalization\" href=\"https:\/\/www.italiancertificates.com\/en\/blog\/certified-translations-and-legalization\/\" target=\"_blank\" rel=\"noopener\">officially translated<\/a>\u00a0<\/strong>to enable its international use.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This is the certificate issued by the\u00a0Public Prosecutor Office\u00a0to verify the existence of\u00a0outstanding criminal proceedings, already registered in a particular Public Prosecutor\u2019s office, involving the person owner of the certificate.
